Guidelines on Data and Materials Retention

Original data and materials derived from University research are the sole property of the University. They may be required in the event of a misconduct allegation, particularly in connection with research conducted under Federal or other external sponsorship. In addition, original data and materials may be required in the event of a challenge to the validity of a patent based on them.

Original data and materials may not be removed from University premises. However, researchers who leave the University are entitled to:

    (a) make copies of any data they have generated and
    (b) remove any material that is not one of a kind, provided that prior written approval is obtained from all of the following:
    1. (i) the principal investigator of the project, if any;
    2. (ii) the department chair or center director; and
    3. (iii) the Vice President for Research and Graduate Studies.

'Data' refers to information of any kind, including but not limited to: measurements, chemical formulas, chemical reactions, DNA libraries, databases, computer programs, computer files, printouts, schematics, circuit diagrams, flow charts, sketches, photographs, interviews, spectra, analyses, summaries, and ideas. Data may be recorded on media of any kind, including but not limited to: notebooks and other paper, digital storage media, audio and video tape, and photographic film.

'Materials' refers to tangible items of any kind, including but not limited to: media on which data are recorded, equipment, instruments, devices, prototypes, models, samples, reagents, cell lines, animals, and plants.

'University research' refers to research that is conducted on University time or uses a University facility or resource.
