FMLA Expanded for Military Leave

 

Temple’s Family and Medical Leave policy will be updated to reflect legislation that expands the Family Medical Leave Act (FMLA) to provide unpaid leave to employees who are caregivers of wounded military personnel and to employees whose family members are about to go on active military duty.

Effective January 28, 2008, employees are eligible for up to 26 weeks of unpaid leave during one 12-month period to provide care to injured U.S. military personnel. The employee must be a spouse, child, parent, or nearest blood relative of the service member.


An additional expansion will be effective as soon as the U.S. Department of Labor issues final regulations. That expansion will to provide up to 12 weeks of unpaid leave to employees whose immediate family members (spouses, children or parents) are soldiers, reservists or members of the National Guard who are or are about to go on active military duty for any “qualifying exigency,” such as an overseas assignment, recall to active duty or troop mobilization.
