Step 1: The department submits a COMPLETE H-1B Application along with all necessary checks and supporting documents to Martyn J. Miller in 403C Conwell Hall. Please note that applicant can not begin working until department is given express permission from Human Resources to begin employment. The employer must agree to pay an H-1B nonimmigrant the required wage rate, which is defined as the higher of the actual and prevailing wage rates.
Step 2: Upon determination that the employee will be paid the required wage rate, OIS requests that Human Resources post the salary/position information according to Department of Labor regulations. It may take several days for HR to confirm posting.
Step 3: OIS files a Labor Condition Application (LCA) with the U.S. Department of Labor (DOL). This step is required to monitor employment conditions and prevent the employment of H-1B employees where the employment would potentially have an adverse impact on the wages and working conditions of American workers. Once DOL certifies the LCA, Martyn will forward the H-1B application to Sharon Loughran in the main OIS office at 1700 N Broad Street, Suite 203B .
Step 4: Sharon will process the H-1B forms and then send the LCA and Form I-129 to USCIS along with supporting documentation and the required checks.
Step 5: USCIS will mail OIS an I-797 Receipt notice for the petition, which will contain a tracking number (ex: WAC123456789). OIS will email the tracking number so that the department and the H-1B worker can track the status of the case.
Step 6: USCIS will mail OIS an I-797 Approval Notice. OIS will then email the applicant, the department and HR with instructions regarding the H-1B employment begin date. |
